Study: New York drug courts prevent recidivism

NEW YORK (AP) _ Treatment programs may be more effective than prison in keeping drug offenders from being arrested again, according to a study of New York State's drug courts.

Offenders who completed court-supervised programs were 29 percent less likely to be re-arrested than those who went to prison, said the study by the Center for Court Innovation, an independent research arm of the New York State court system. The study was reported in Sunday editions of the New York Times.

"These are very positive findings, I think, getting to the answer of whether drug courts work in reducing recidivism," Deborah Daniels, who oversees U.S. Justice Department grants to New York state drug courts, told the Times.

The findings apply only to offenders who completed their court-supervised programs. About half of those who began treatment dropped out of treatment before finishing.

Drug courts for adults have thrived since the 1990s, when prison overcrowding drove New York state governments to seek less costly ways of dealing with nonviolent drug offenders.

The courts allow people who have been charged with drug offenses and to choose intensive substance abuse counseling and supervision instead of prison. Only nonviolent offenders are typically allowed to opt for treatment; more serious criminals are usually incarcerated.

The programs have saved New York State $254 million in incarceration costs, according to the Center for Court Innovation study.

Officials in other states _ including Nebraska and Idaho _ have also proclaimed drug courts a success.

But some New York state officials have expressed skepticism about the programs' effectiveness. After Connecticut withdrew funding for its drug courts last year, the state's chief court administrator, Joseph Pellegrino, told the Associated Press that the courts "may not have been as successful as we may have thought."
