New York Chef Arrested on Drug ChargesAlex Garcia, a chef who helped popularize Nuevo Latino food at several New York City restaurants and on television, has been charged with conspiracy and money laundering in connection with a drug ring that is said to have imported thousands of pounds of cocaine.
The authorities, who seized more than $1.6 million and 220 pounds of cocaine during their investigation, arrested Mr. Garcia and 17 other people late last month. Mr. Garcia was arraigned in federal district court in Brooklyn on Monday and pleaded not guilty to the charges. He is free on $500,000 bond.
The indictments say that Mr. Garcia paid drug couriers, including airline employees, at Babalu, the restaurant and club on West 44th Street where he was the chef. Allah Zaki, who was the manager of Babalu, is also a defendant in the case.
Mr. Garcia, who has appeared on the Food Network, was also the chef at LQ, a nightclub and restaurant in the Radisson Hotel on Lexington Avenue. He was to be the chef in the soon-to-open Zona Rosa, a Mexican spot in Midtown.
Brian Caplan, the lawyer for Ralph Mercado, a music executive who is the principal owner of Babalu, LQ and Zona Rosa, said his client had no knowledge of the dealings alleged to have taken place at Babalu and that Mr. Mercado was never under investigation. Mr. Garcia is on a leave of absence from the restaurants, Mr. Caplan said.
The complaint also says that "drug proceeds from bank accounts associated with Babalu" were sent to Santa Fe Margarita Grill, a restaurant in Norfolk, Va., that was owned by Mr. Garcia's brother, Rene Mayor Garcia, another defendant.
Mr. Caplan said that Alex Garcia was not an owner of Babalu and that neither he nor Mr. Zaki had authority to sign checks there.
In a telephone interview, Mr. Garcia denied any involvement in drug dealing. "I sent my brother money to help him pay the rent for the restaurant," he said. "They've misinterpreted the information."
"I know my career is down the tubes," he said. "It's a rough time for my family and the people who work in my restaurants."
Mr. Garcia's lawyer, Richard Wojszwilo, said the charges were based on conversations taken out of context. Prosecutors said the case involved wiretaps.
The complaint also mentions Calle Ocho, the Upper West Side restaurant where Mr. Garcia was the chef until the fall of 2001, as another location where drug money was exchanged. Steve Scher, whose company, Main Street Restaurant Partners, owns Calle Ocho, described Mr. Garcia as a "huge talent who liked to party," and said that to his knowledge, his restaurant was not involved.
The investigation began in January 2001. Federal prosecutors said the drug ring shipped the cocaine to the United States from the Dominican Republic. Cocaine that the ring was importing was found during a search of a plane headed for Newark that was diverted to Bermuda International Airport on Sept. 11, 2001, investigators said. They were alarmed by the ring's ability to breach security at airports.
If convicted, each defendant faces a maximum sentence of life in prison and $4 million in fines.
At LQ, Rodney Mitchell has been promoted to be the executive chef. And Adrian Leon, who was the chef de cuisine at Rosa Mexicano Lincoln Center, is to be the executive chef at Zona Rosa, which is now set to open in about 10 days.
