New Study Shows that Drug Treatment Courts Are Working in New York State


Since Oswego County, New York Drug Treatment Court began in 1999, nearly 50 people who had been accused of drug crimes have turned their lives around. They were accepted into drug treatment court and completed the treatment and rehabilitation programs that they agreed to. Most of them are back with their families, working, and living productive lives in their community.

"Drug treatment court programs give non-violent addicted offenders a chance to complete an intensive treatment and rehabilitation program that is monitored by the court," said David Guyer, program coordinator for Oswego County, New York Drug Treatment Court. "Participants sign a contract stating that they will comply with all conditions of treatment and supervision."

Those who don't complete the program have their original criminal charges restored. People who are charged with a violent crime or have a history of violence aren't accepted into the program.
"The goal of our program is to reduce substance abuse and drug-related crime in Oswego County,New York" said Guyer. "Statistics show that drug treatment courts are successful in reducing re-arrest or recidivism rates, and reducing substance abuse."

Acting County Court Judge James Metcalf supervises the county drug treatment court program. Defendants are required to appear frequently before Judge Metcalf to report on their progress. Defendants may attend up to 10 treatment sessions and self-help meetings a week. The court supervision and treatment program lasts over a year, depending on the person's addictions and progress in the program.

County Legislature Chairman Morris Sorbello, who has attended many of the court graduation ceremonies, said he's seen people of all occupations and all walks of life who have fallen victims to drug abuse overcome their addictions.

"The graduation ceremonies are a humbling experience," said Legislator Sorbello. "These individuals show a great deal of determination and self-discipline. Treatment court makes it possible to break the cycle of addiction and criminal behavior."

He said he is especially impressed with families whose children are placed in foster care while a parent completes the treatment program. "It is very rewarding to see parents be able to get the children back and the family re-united," he said.

The next graduation program will take place later this winter.

A recent study by the U.S. Department of Justice showed that drug treatment courts have reduced recidivism by nearly 32 percent in New York State. Oswego County, New York experience mirrors the success rates cited in the Department of Justice study. The study also found a direct correlation between the seriousness of the charge and the offender's success in drug court. Those facing more serious charges and longer prison terms are more likely to remain in drug court treatment.

Allowing a non-violent offender to enroll in a treatment program also saves taxpayers' money.
"Over 18,000 individuals in New York have participated in drug court programs. The court system estimates that taxpayer savings have totaled over $254 million in incarceration costs alone in New York State," said Guyer. "That doesn't include the savings in social services costs such as foster care and public assistance programs that serve families of drug addicts."

Oswego County, New York Drug Treatment Court is funded by the New York State Unified Court System. The program began as the result of a federal grant from the U.S. Department of Justice. The county probation department applied for the original funding.
